Depositata nei giorni scorsi in Tribunale a Brescia la sentenza in merito all’azione legale relativa al pagamento dello spettacolo pirotecnico voluto il 3/4 maggio 2002 dall’amministrazione comunale di Rovato (sindaco: Roberto Manenti). Filed in recent days in a Brescia court ruling on the legal action relating to the payment of fireworks wanted 3 / 4 May 2002 by the municipal administration of Rovato (Mayor: Roberto Manenti).
Il Tribunale ha condannato l’ex sindaco rovatese, assieme all’ex comandante dei vigili urbani di Rovato Roberto Opizzi, che firmò la determina, a risarcire la ditta “Parente Fireworks” di Melara (Rovigo) per un totale di 120mila euro, più interessi legali maturati in questi cinque anni. A tale cifra vanno poi sommate le spese legali sostenute dal Comune di Rovato (che si era in seguito rifiutato di pagare il salato conto dei fuochi d’artificio) e dagli altri soggetti coinvolti, per un computo che dovrebbe quindi superare i 200mila euro. Compared with information from the press site and I think that might be useful to add some details.
Manenti The administration had not provided coverage not only a budget of € 120,000 of 145,000 for fireworks, but also of € 11,000 for clearing snow, € 23,500 for changes to PRG in 2002, € 12,000 for the census of 2001 .
We are touched and then decide whether to assume the responsibility to pay expenses that had not run, is to find the money.
On the first point, the strict observance of the law, as it emerges from the ruling, has helped us, we decided to pay the three charges for a total of € 46,500 (trying to find the money) because the benefits were clear and documented.
We decided to pay € 25,000 invoice fireworks (that relating to advertising of the event and other expenses) as documented and demonstrable beyond that provided in the budget.
We have decided not to pay € 120,000 expenditure because it was not documented and was not longer possible to demonstrate that the post was the value of the benefit. There was even a quote or more.
In addition, the auditors of the City (appointed by Manenti in 2000) have now expressed their total opposition to assume the responsibility to give a positive opinion to the payment, for the reasons mentioned above.
In summary, we are where we have taken steps to remedy the situations. Where there was significant risk of losing out of pocket for their choices of others we care.
The ruling in this sense is a post-confirmation of the validity of choices at the time.
